Complete guide to registering a society in India under the Societies Registration Act, 1860. Learn about eligibility, required documents, the registration process, and compliance obligations for registered societies.

What Is a Society?

A society is a group of persons associated together for carrying out a charitable, literary, scientific, educational, religious, or social welfare purpose. Societies in India are governed by the Societies Registration Act, 1860 and respective state amendments. Unlike companies, societies operate on a non-profit basis — any income or surplus must be used for the society's objectives and cannot be distributed to members.

Societies are popular for NGOs, educational institutions, hospitals, cultural organisations, residents' welfare associations, sports clubs, and professional bodies.

Types of Societies

  • Charitable Societies: For social welfare, poverty alleviation, healthcare
  • Educational Societies: Running schools, colleges, training institutions
  • Religious Societies: Managing religious activities and institutions
  • Literary/Scientific Societies: Promoting literature, research, science
  • Cultural Societies: Promoting art, music, dance, and cultural heritage
  • Residents' Welfare Associations (RWAs): Managing residential community affairs

  • Rules and Regulations: Internal governance rules including membership criteria, meeting procedures, election of governing body, accounts maintenance, and amendment procedures
  • Identity Proof: PAN, Aadhaar, and address proof of all governing body members
  • Address Proof of Registered Office: Rent agreement/ownership deed + utility bill + NOC from landlord
  • Affidavit from President/Secretary: Declaring the genuineness of the application and that all members have agreed to form the society
  • Minutes of the first meeting: Resolution to form the society and approve the MOA and Rules

Step-by-Step Registration Process

Step 1: Choose a Name

Select a unique name for the society. The name should not be identical or similar to an existing registered society or company. Include words that indicate the nature of activities (e.g., "Educational Society", "Welfare Trust").

Step 2: Draft the MOA and Rules

Prepare the Memorandum of Association with clearly defined objectives and the Rules and Regulations for internal governance. Both documents must be signed by all founding members.

Step 3: Collect Members' Details and Documents

Gather identity documents, photographs, and signatures of all 7+ founding members. Designate the President, Vice President, Secretary, Treasurer, and other governing body members.

Step 4: Submit Application to the Registrar

File the application with the Registrar of Societies in the state where the registered office is located. Most states now have online portals for society registration. Submit all documents along with the prescribed registration fee.

Step 5: Verification and Registration

The Registrar verifies the application and documents. If everything is in order, the society is entered in the Register of Societies, and a Registration Certificate is issued. The process typically takes 15-30 working days depending on the state.

Post-Registration Compliance

  • Annual Filing: Most states require annual filing of society's accounts and list of managing committee members with the Registrar of Societies
  • General Body Meeting: At least one AGM per year with proper notice and minutes
  • Managing Committee Elections: Regular elections as per Rules and Regulations
  • Income Tax Return: If the society has income, file ITR-7. If 12A-registered, claim exemption
  • 12A and 80G Registration: For tax exemption and to offer tax benefits to donors
  • FCRA Registration: If receiving foreign contributions
  • Audit: Annual audit by a Chartered Accountant (recommended/required depending on income)
