What Is FCRA?

The Foreign Contribution (Regulation) Act, 2010 (FCRA) regulates the acceptance and utilisation of foreign contributions (donations, grants, and aid) by individuals, associations, and companies in India. FCRA is administered by the Ministry of Home Affairs (MHA). Any organisation that wishes to receive foreign contributions must obtain FCRA registration or prior permission from the Central Government.

FCRA was enacted to ensure that foreign contributions are utilised for the stated purpose and do not affect the sovereignty and integrity of India. The Act imposes strict conditions on who can receive foreign contributions and how they must be utilised and reported.

Who Needs FCRA Registration?

  • NGOs, trusts, societies, and Section 8 companies that receive foreign donations
  • Organisations receiving foreign grants for projects (healthcare, education, environment, social welfare)
  • Religious organisations receiving foreign funding for charitable activities

Who Cannot Receive Foreign Contributions?

  • Candidates for election

Eligibility for FCRA Registration

  • The organisation must be registered as a trust, society, or Section 8 company under Indian law
  • Must have been in existence for at least 3 years
  • Must have spent at least ₹10 lakh on its core activities during the last 3 financial years (excluding administrative expenses)
  • Must have a reasonable activity track record and financial discipline
  • Office bearers should not have any criminal antecedents
  • The organisation should not have been prohibited from receiving foreign contributions earlier

Step-by-Step FCRA Registration Process

Step 1: Prepare Documents and Records

Ensure your organisation meets all eligibility criteria. Gather 3 years of audited financial statements, activity reports, and governing body details.

Step 2: Open a Designated FCRA Bank Account

As per the FCRA Amendment Act, 2020, every FCRA-registered organisation must maintain a designated FCRA bank account at the SBI Main Branch, New Delhi (11, Sansad Marg, New Delhi - 110001). Foreign contributions must first be received in this designated account before being transferred to a utilisation account.

Step 3: Apply Online on the FCRA Portal

File the application on the MHA's FCRA portal (fcraonline.nic.in):

  • For new registration: Form FC-3A
  • For prior permission: Form FC-3B

Upload all required documents including:

  • Registration certificate of the trust/society/Section 8 company
  • Trust deed / MOA / Constitution
  • Audited financial statements for the last 3 years
  • Activity report detailing projects and beneficiaries
  • Details of governing body members with Aadhaar and PAN
  • Darpan portal registration certificate (mandatory for NGOs)

Step 4: Pay the Application Fee

Pay ₹5,000 for FCRA registration or ₹3,000 for prior permission through online payment.

Step 5: MHA Verification

The MHA conducts verification, which may include:

  • Review of the application and documents
  • Field inquiry through Intelligence Bureau (IB) or state police
  • Assessment of the organisation's track record and credibility

Step 6: Grant of Registration

If the MHA is satisfied, FCRA registration is granted for a period of 5 years. The organisation receives a unique FCRA registration number. The process typically takes 3-12 months depending on the complexity of verification.

Annual FCRA Compliance

  • Annual Return (FC-4): Every FCRA-registered organisation must file an annual return in Form FC-4 within December 31 of each year, covering contributions received and utilised during the preceding financial year.
  • Designated Bank Account: Maintain the SBI New Delhi account for receiving all foreign contributions.
  • Utilisation Account: Foreign funds can be transferred to one utilisation account in a scheduled bank for project expenses.
  • 50% Administrative Expenses Cap: Not more than 50% of foreign contributions can be spent on administrative expenses (amended from the earlier 50% limit in 2020).
  • Audit: Annual audit of FCRA accounts by a Chartered Accountant.
  • Intimation of Change: Any change in key functionaries, address, or bank account must be intimated to MHA within 15 days.

FCRA Renewal

FCRA registration must be renewed every 5 years. The renewal application should be filed in Form FC-3C at least 6 months before expiry. Failure to renew results in the registration being deemed expired, and the organisation can no longer receive foreign contributions.

Penalties for Non-Compliance

  • FCRA Cancellation: MHA can cancel registration for violations
  • Fund Freezing: MHA can direct banks to freeze the organisation's FCRA accounts
  • Criminal Prosecution: Imprisonment up to 5 years and fine up to ₹10 lakh for accepting foreign contributions without registration
  • Prohibition Orders: MHA can prohibit an organisation from receiving foreign contributions
